Violation of the provisions of this chapter, or failure to comply with any of its requirements, shall be subject to enforcement actions by the city administrator that are authorized in the zoning ordinance, subdivision ordinance, shoreline master program or any other land use regulation of the City of Kettle Falls. The city attorney, when authorized by the mayor and council, shall seek additional penalties, remedies, injunctions and other legal sanctions necessary for the enforcement of this title and require immediate remedial actions (e.g., restoration plans), proposed and implemented by a qualified professional, to the critical area(s) impacted by said violation. In addition to costs allowed by these regulations, the prevailing party in an enforcement action may, at the court’s discretion, be allowed interest and reasonable attorney’s fees. The city attorney shall seek such costs, interest, and the reasonable attorney’s fees on behalf of the City of Kettle Falls when the city is the party. (Ord. 1803, §1, 2022).
