At such time any special user begins discharging industrial wastes into the sewer system, they shall be subject to industrial cost recovery requirements adopted by the City at that time. Industrial wastes shall be defined under Section 35.905-8 of the Environmental Protection Agency Construction Grant Regulations 40 CFR Part 35, and discharged to the treatment facilities constructed by the City under EPA Grant No. C053-465. The City shall develop and adopt an industrial cost recovery system that complies with the requirements of Public Law 92.500 and all regulations and guidelines pertaining thereto and that are acceptable to the Environmental Protection Agency. In the interim, the City shall submit an annual certification affirming the non-existence of industrial discharges to the facilities.
